Discovery comes just a few hours after a scott county grand jury charged 53-year-old joseph hicks with sheena baxter's murder he is also charged with robbery...which makes this eligible to be a death penalty case.

Joseph hicks was already in jail after being arrested last week on charges of filing a false police report and tampering with evidence.

Police say he told them he was shot during an attempted robbery at a store in georgetown on the day baxter disappeared, but police say surveillance video showed it didn't happen...that hicks made the story up.

They say his gunshot wound is connected to baxter's murder.

Even without a body...investigators say they have "overwhelming evidence" to charge hicks with the murder.

According to police, baxter and hicks were recently in contact with each other.

Baxter was at her sister's house valentine's day when police say she was going to make a quick trip outside...and disappeared.

Her sister wants hicks to start talking to investigators.

She wants to know what happened to her sister.

"i want him to speak, i want him to give answers.

I'm going to continue showing up, staring him down.

I'm not scared."

Georgetown police and the scott county sheriff's office have been helped in this investigation by the f-b-i and the lexington police department's forensics unit.

Police say this is still an active investigation with a lot more questions to answer...but they are convinced they have baxter's killer.
